Defendant shall be punished by a fine of 12 million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On February 16, 2016, the Defendant was issued a summary order of KRW 1 million by the Seoul Western District Court as a crime of violation of the Road Traffic Act.

The defendant is a person who is engaged in driving a BMW 320d car.

1. Although the Defendant violated the Road Traffic Act (driving) one time, the Defendant driven the said BMW 320d car under the influence of alcohol concentration of approximately 0.096% from the 10km section from the Mapo-si, Militarypo-si to the Mapo-si, Military-si, Military-si, Military-si, at around 03:20 on January 4, 2020, while under the influence of alcohol content of about 0.096%.

Accordingly, the defendant, who violated the drinking driving at least once, was driving a motor vehicle again under the influence of alcohol.

2. Violation of the Road Traffic Act (Ch.A.) was driven by the Defendant while under the influence of alcohol at the time specified in paragraph (1), and the Defendant driven the above car along the six-lanes of the Ch. C. C. C., at the king-si, at a point of 28 km from the military bridge to the fl.m. of the 6-lanes.

Since there are 4 PErums and 7 PE bank protection walls, there were duty of care to prevent accidents in advance by accurately manipulating and safely driving the steering gear, etc. of the vehicle and driving the vehicle.

Nevertheless, the Defendant, while under the influence of alcohol, was negligent in operating the steering direction and brakes from time to time, did not meet the front part of the said vehicle, and caused four PErums and seven PE protection walls installed on the right side of the one-lane access road of the said vehicle.

The Defendant, by its occupational negligence, destroyed four PErums and seven PE bank walls managed by the Korea Highway Corporation established under the Korea Highway Corporation, and escaped without immediately stopping and taking necessary measures, even though it damages approximately KRW 1,840,300 for repair costs.
