Defendant

A is the representative director of social welfare foundation B located in Sung-nam City G, and Defendant B is a corporation established for the purpose of establishing and operating a general social welfare center.

1. Where a social welfare foundation intends to sell, donate, exchange, lease, provide security, or change the purpose of use with respect to fundamental property, the Defendant A, without obtaining permission from the Minister of Health and Welfare, without obtaining permission from the said social welfare foundation B, leased the 1,301.29 square meters of the 3rd floor of the 1,301.29 square meters of the 4th floor of the building, the 258th floor of the 5th floor of the building, which is the fundamental property of the said social welfare foundation B, to the said social welfare foundation, and received KRW 509,718,900 of the aggregate amount of rent for seven occasions from around that time until February 29, 2012.

Accordingly, Defendant A leased the fundamental property of social welfare foundation B without obtaining permission from the Minister of Health and Welfare.

2. Defendant B performed the act as stipulated in paragraph (1) in relation to the work of Defendant B’s social welfare foundation at the date, time, and place as stipulated in paragraph (1).
