A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[2012 Highest 5787] The Defendant was registered as a business operator in the name of the victim C on October 201, 201, and decided to purchase plastic recycling materials in Korea with the victim and deliver them to the Chinese customer. However, the Defendant was in charge of managing domestic and foreign customers and managing funds, and the victim was in charge of inspecting the goods.

On October 21, 201, the Defendant received KRW 22,954,00 from a business bank account (F) in the name of the victim from a business entity in the name of the customer in the business entity of Kugu-gu, Young-si, Young-si, in the custody of the said amount for the victim on October 24, 201, and transferred KRW 1,200,000 out of the said amount to a "business entity" account, a gambling site, and embezzled casino games from that time to February 22, 2012 by arbitrarily consuming KRW 864,413,750, which was remitted to the said account in the same manner as written in the list of crimes committed in the attached Table.

[2013 Highest 930] The defendant is a person who purchases plastic recyclable materials in Korea with the trade name of H and supplies them to Chinese customers. The victim I is a person who manufactures and performs wholesale business with the trade name of J.

피고인은 2012. 4. 4.경 충북 청원군 K에 있는 J 사무실에서, 피해자에게 “중국으로 수출할 물량이 필요하니 플라스틱 재생원료(제품명 힙스펠렛)를 생산해서 공급해 주세요, 중국에 수출해서 대금을 받아 바로 송금해 주겠습니다”라는 취지로 거짓말을 하였다.

However, the facts are as follows: (a) the Defendant registered a business in the name of C from October 201 to February 2012 and operated D; and (b) the Defendant voluntarily uses part of the export amount remitted from La company, which is the customer of China, and exports the products supplied by the victim because it did not export plastic regeneration products.
