1. The defendant shall pay 78,00,000 won to the plaintiff and 12% per annum from October 3, 2019 to the day of complete payment.
Reasons
Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 5 (including the provisional number), the plaintiff entered into a lease agreement with the defendant on July 27, 2018 on the deposit deposit for the original C apartment and D (hereinafter referred to as "the apartment of this case") owned by the defendant with the term of 78,00,000 won, the term of lease from August 11, 2018 to August 10, 2019, the above lease agreement was terminated as the expiry date, and the plaintiff delivered the apartment of this case to the defendant on October 2, 2019.
According to the above facts, the defendant is obligated to pay to the plaintiff delayed payment at the rate of 12% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from October 3, 2019 to the date of full payment, following the delivery date of a copy of the complaint of this case and the copy of the complaint of this case to the plaintiff.
Therefore, the plaintiff's claim of this case is accepted on the ground of the reasons.
