A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant provided 106 telephone counseling to B call centers from January 2017 to December 2017, and habitually provided abusive and verbal abuse.

1. 피해자 C 피고인은 2017. 11. 20. 22:54경부터 2017. 11. 21. 02:19경까지 불상의 장소에서 B콜센터에 수회 전화하여 이전 상담사가 퇴근하여 통화를 할 수 없어 화가 난다는 이유로 전화상담사인 피해자에게 “내일 아침까지 괴롭혀 주겠다, 내 말 묵살하는 것에 대한 대가를 치르게 해주겠다, 병신같은 년, 씨발, 씹빵창 만들어 버리겠다, 확 보지 찢어서, 확 찢어 갖고 죽여 버릴 씨발년아”라고 말하여 피해자를 협박하였다.

2. Victims D;

A. 3. 피해자 E 피고인은 2017. 8. 21. 16:49경 불상의 장소에서 B콜센터에 전화하여, 자신의 말을 잘 알아듣지 못한다는 이유로 전화상담사인 피해자에게 “사람이 좋게 좋게 하니까 보자기가 씨발 좆같이 보이세요, 전달 안 해주시고 쌩까면 어떤 식으로라도 대가를 치르게끔 만들 거야, 책임자 연락이 없으면 고발하겠다, 공무원들까지 싹다 일자리 잃게 만들어 버릴 테니까”라고 말하여 피해자를 협박하였다.
