Defendant shall be punished by a fine of KRW 1,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The defendant is a person who is engaged in daily work at the construction site.

In order to obtain a loan for workers' livelihood guarantee from a financial institution, any person shall submit to the financial institution the certificate of work (employment) proving that the borrower actually works and the details of the passbook deposited for not less than three months.

Nevertheless, around July 6, 2010, the Defendant filed an application for a loan for workers' livelihood guarantee at the Cheongdong-gu 255-1 Cheongdong-dong 255-1, and submitted the D's work (employment) certificate and the passbook deposited by D's National Agricultural Cooperative Federation.

However, there was no fact that the defendant did not receive the above benefits since he did not work at the place of "C".

As such, the defendant deceivings the victim's threat, and he immediately received eight million won of the worker's life guarantee loan from the victim, thereby deceiving the victim.
