A fine of 2 million won is imposed on the crimes in the section 1 to 6 of the crime sight table among the crimes in the section 2019 order 541(1) of the judgment of the defendant.
Reasons
Punishment of the crime
[2019 Highest 541] The Defendant was sentenced to eight months of imprisonment for fraud at the Daegu District Court on June 16, 2016, and the said judgment became final and conclusive on September 20, 2016, and the execution of the sentence was terminated on December 4, 2016 at the Daegu Detention House.
1. Around 04:20 on September 23, 2018, the Defendant was driving as if he were to pay the taxi expenses in front of the smuggling station located in the center of the 62-ro of the west-si, Chungcheongnamyang-si, and was moving by using the said taxi to the front of the mountain station located in the center of the Gyeongsan-si, the 05:30 on the same day.
However, since the defendant did not have money possessed at the time, there was no intention or ability to pay taxi expenses from the beginning.
As above, the Defendant: (a) by deceiving the victim; (b) obtained financial benefits equivalent to KRW 50,00 from the victim’s immediately after being provided with a taxi equivalent to the same amount of KRW 50,000; and (c) obtained financial benefits from the taxi or train from December 25, 2014 to the aforementioned temporary date; and (d) received financial benefits from the total amount of KRW 262,200,00 in property or acquired financial benefits on nine occasions by taking advantage of the taxi or train between the taxi and train from December 25, 2014 to the above temporary date.
2. On October 12, 2018, the Defendant violated the Punishment of Minor Offenses Act: (a) around October 20, 2018, the Defendant, at the seat of the train No. 157 of the KTX No. 157, sent alcohol to the front by avoiding the disturbance of alcohol from the guest room No. 9 of the KTX No. 157, and, without good cause, expressed a desire to “scoping” to female passengers on the name of the passenger on the side.
[2019 Highest 1666] The Defendant was issued normal boarding passes in the train of Busan FTX No. 166 operated by the Korea Railroad Corporation, as the Defendant used the train in Busan Highest 206, around March 26, 2019.
