1. Facts of recognition;

가. 반소원고는 2002. 10. 25.경 하남시 C 대 148㎡와 그 지상 연와조 슬라브즙 평가건 주택 빛 근린생활시설 66.78㎡，지하실 66.78㎡(내역 지하실은 세멘벽돌조 스라브임, 이하 ‘이 사건 부동산’이라 한다)을 매수하면서 주식회사 신한은행(이하 ‘신한은행’이라 한다)으로부터 대출받았고, 이를 담보하기 위하여 이 사건 부동산에 관하여 채권최고액 117,000,000원, 채무자 반소원고, 근저당권자 신한은행으로 하는 근저당권설정등기를 경료하여 주었다.

B.
