1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

The defendant asserts to the effect that the lawsuit of this case is unlawful, since he/she received a decision to grant bankruptcy or immunity.

According to the evidence Nos. 1 and 2, the defendant is recognized as having been declared bankrupt and granted immunity as the District Court Nos. 2011Hadan2018, 2011, and 2011, after the occurrence of the claim stated in the attached Form No. 1 and 2 (hereinafter “the claim of this case”).

Therefore, the instant claim is unlawful as there is no benefit of protection of rights, since the right and executory power of filing a lawsuit that has ordinary claims is lost.

Thus, the defendant's above argument is reasonable, and the lawsuit of this case is dismissed.
