1. The Defendant shall pay to the Plaintiff KRW 42,00,000 and the interest rate of KRW 15% per annum from August 31, 2017 to the day of complete payment.

1. Basic facts

A. The Defendant issued and delivered 14 copies of household checks (hereinafter “instant checks”) to the Plaintiff as follows:

B. (1) On January 4, 2017, the Plaintiff leased KRW 30 million to Nonparty R, the Defendant’s wife, as of January 21, 2017, with the due date set as of January 21, 2017. Of the instant checks, the Plaintiff was issued for the purpose of securing the above loan obligations.

(2) In addition, on January 2017, the Plaintiff additionally lent KRW 12 million to Ra on January 21, 2017, which was issued for securing the above additional loan obligations. Of the instant checks, the Plaintiff issued the said additional loan obligations.

C. As the Plaintiff did not repay the above loan at the time when the R promised, the Plaintiff presented the instant check lawfully on each day indicated in the “date of presentment” date.
