1. A sales contract concluded on November 17, 2015 with regard to each real estate listed in the separate sheet between the Defendant and B is 83,224.
Reasons
1. Basic facts
A. 1) The Plaintiff Co., Ltd. (hereinafter “C”)
ii) Han Bank Co., Ltd. (former Korea Exchange Bank, Inc., hereinafter referred to as “one Bank”);
(C) In order to guarantee the repayment of a loan from a loan, a credit guarantee agreement is concluded between C and a guarantee amount of 180 million won on April 24, 2012 and the term of guarantee until April 23, 2013 (hereinafter “instant credit guarantee agreement”).
(2) At the time of concluding the instant credit guarantee contract, C entered into an agreement with one bank to pay the Plaintiff the amount of subrogation and the damages for delay calculated at the rate determined by the Plaintiff from the date of payment of the amount of subrogation to the date of payment of the amount of payment of the guaranteed obligation if the Plaintiff performed the guaranteed obligation at the time of concluding the instant credit guarantee contract, and C’s representative director, B guaranteed all the obligations owed by C to the Plaintiff in accordance with the instant credit guarantee contract.
3) As a credit guarantee accident occurred on December 9, 2015, following C’s delinquency in paying the principal and interest of loan to Han Bank on October 12, 2015, Han Bank notified the Plaintiff of a credit guarantee accident on February 1, 2016, and on March 8, 2016, requested the Plaintiff to discharge the guaranteed obligation under the credit guarantee contract of this case. On March 31, 2016, the Plaintiff subrogated to Han Bank KRW 171,442,110 on June 9, 2016, the Plaintiff filed an application with the Daegu District Court 2016 tea7364, with the Plaintiff for a payment order seeking compensation for the said subrogated payment on July 14, 2016, the payment order of KRW 171,613,480, and damages for delay included in the amount of KRW 171,231,416,214,316.
