Accordingly, the defendant interfered with legitimate execution of duties concerning the prevention, suppression and investigation of police officers' crimes.

The relevant legal provisions on criminal facts, Article 136(1) of the Criminal Act on the selection of punishment, the fact that the defendant's reason for sentencing of sentencing of imprisonment is acknowledged to commit a crime and reflects wrongness, and that the degree of violence against police officers is not heavy, etc. are favorable factors for sentencing. The Defendant again commits the instant crime during the period of probation, even though he/she was sentenced to two years of suspended sentence on September 16, 2015 by obstructing a police officer from engaging in his/her business on September 16, 2015.

The sentencing factors and other factors of the defendant's age, sex, environment, motive and background of the crime, means and consequence of the crime, and circumstances after the crime, etc. shall be determined as per the order of the sentencing guidelines within the scope of the recommended sentence (no more than eight months of imprisonment: interfered with the execution of official duties, interference with the performance of official duties, interference with the performance of official duties, type 1, mitigation area (in the event the degree of violence is minor)).
