A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the vice head of Young-do G in Busan Metropolitan City H(State).

1. Since 2012, the Busan Regional Maritime Affairs and Fisheries Office ordered the "I Bath Coast Coast Maintenance Project", which is a national project equivalent to 43.5 billion won in total, in order to promote the convenience of the people by preventing sand loss on the side of the Busan I Bathing Beach and expanding tourism infrastructure.

On November 15, 2012, the Busan Regional Fisheries Authority selected K (ju), L, and M as a sand supply business operator from among the I bathing beach coastal maintenance projects. The above companies entered into a sand supply contract with the shipping company, such as H (ju), N,O, Han River, P, and Q, with a sand gathering right from the Korea Water Resources Corporation for sand supply.

H agreed to supply sand to K (main) and submitted a "verification report" which appraised sand loading on a sand carrier at the time of the supply of sand to the supervisor, and submitted a sand loading to the Busan Regional Maritime Affairs and Fisheries Agency for the inspection of the sand quantity, and accordingly, the supply price is to be delivered.

A. The Defendant altered a private document by submitting a test report stating the load loading capacity of “R” and “S”, which is a sand carrier of H (State) and “S”, to revise a test report in order to obtain sand payment from the Busan Regional Fisheries Administration, which is the place where the “I Bath Coast Improvement Project” is ordered.

On December 2, 2013, the Defendant: (a) prepared a number using a unit protocol at H (ju) office located in the Young-gu Busan Metropolitan City (U.S.); and (b) recorded the “R” on June 9, 2009, a verification report (report number No. FST-0908-1459) prepared by a certified company affiliated with the approval company of the A.S. in charge of the FS-08-1459) with respect to the “R,” added the above number to the cargo hold depth and maximum load; and (c) copied the cargo hold depth (the cargo hold depth 9.14M to October 57M).
