A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the head of the victim E apartment reconstruction association in Busan Dong-gu (hereinafter referred to as the " reconstruction association"), who is a person in charge of overall management, such as the selection, sale, accounting, etc. of the construction works of the above reconstruction association.

On September 28, 2011, a reconstruction association filed a civil suit (in Busan District Court Decision 201Gahap19259, etc.) with the Busan District Court on the ground of the Act on the Improvement of Urban Areas and Dwelling Conditions for the Maintenance of Residents (hereinafter “Seoul District Court”) stating that “The sales contract between the reconstruction association and the Dong-gu Office is null and void,” and the Busan District Court rendered a judgment on November 28, 201, stating that “The Dong-gu shall pay 506,985,46 won to the E Apartment Reconstruction Association and its related interest at the rate of 5% per annum from September 24, 201 to November 28, 2013, and 20% per annum from the following day to the date of full payment.”

Therefore, Dong-gu Office deposited KRW 569,282,170 to the reconstruction association on December 23, 2013 in Busan bank (Account Number: G) account in the name of the reconstruction association.

As seen above, the Defendant: (a) withdrawn KRW 5,00,000 from December 24, 2013 to December 24, 2013 in cash and consumed the money for personal purposes, such as living expenses, etc. from Japan within Busan City; and (b) from March 24, 2014 to March 24, 2014.
