On April 17, 2009, the Defendant: (a) determined that the instant building occupied the portion of 39 square meters out of 411 square meters of land in Busan-gu Busan-do, Busan-do, which is a state-owned land adjacent to each of the above land (hereinafter “instant occupied portion”) without permission; and (b) imposed indemnity (including delayed interest) on the Plaintiff as indicated in the table below.

The Defendant did not pay the indemnity imposed as above to the Plaintiff, and ① KRW 14,53,380 [the indemnity amounting to KRW 5,552,320 during the occupancy period from April 1, 1994 to August 1, 2001] from May 19, 2004 to December 16, 2015 (hereinafter “the occupancy period in this case”).

(1) The compensation amount of KRW 8,981,060 is not more than the payment demand amount of the compensation amount.
