Reasons
1. Facts of recognition;
A. On August 28, 1979, D, the father of the Plaintiff, completed the registration of ownership transfer on the ground of sale on February 23, 1979 with respect to the land E large 281 square meters (hereinafter “Plaintiff’s land”). Meanwhile, on December 1, 1993, Defendant B completed the registration of ownership transfer on the ground of sale on November 23, 1996 with respect to the portion of 92.6 percent of the land listed in attached Table No. 1 (hereinafter “1”) as indicated in attached Table No. 1 (hereinafter “the land”), and Defendant C completed the registration of ownership transfer on the ground of sale on May 29, 1996 for the portion of 251.4 percent of the land No. 1, 1996.
On February 22, 2013, Defendant B completed the registration of ownership transfer for the land listed in paragraph (2) of the attached Table No. 2 (hereinafter referred to as “second-party land”) on the grounds of an agreement on division of inherited property as of December 12, 2012, and on May 16, 2013, Defendant B completed the registration of ownership transfer for the land listed in paragraph (3) of the attached Table No. 3 (hereinafter referred to as “third-party land”) on the same day.
E. Meanwhile, as the site for the building of this case (including the portion below the plaintiff's land), the plaintiff occupies 20 square meters inside a ship which connects each point of the attached Form No. 23,29, 28, 30, 31, 21, 22, and 23 among the land in the attached Form No. 1, and 20 square meters inside a ship which connects each point of the attached Form No. 25, 27, 28, 29, 23, 24, 26, 25 among the land in the attached Form No. 2, and 20 square meters inside a ship which connects each point of the attached Form No. 25, 27, 28, 28, 29, 29, 23, 25, 26, 24, and 1 in sequence among the land in the attached Form No. 1 (hereinafter "the land in this case").
