1. Basic facts

A. The defendant is a community consisting of village residents who live in the natural village located in the area of Geumsan-gun, Chungcheongnam-gun in terms of administrative district and live in the area of the natural village. The plaintiff is a resident living in the Geumsan-gun, Chungcheongnam-gun and is currently a head of H Ri.

B. In the area of Kusan-gun, Chungcheongnam-gun, a change in administrative Ri, the administrative jurisdiction was changed as follows:

1) Around October 30, 1914, B Ri (B) was divided into two Ris by around February 1965, and two Ris by around February 2, 1965. (2) around February 1965, D was divided into B Ri, E, I, J, and K Dong by the Ordinance on the Fixed Number of Ris in Geumsan-gun (Dong), respectively.

3) Around December 1973, according to the Ordinance on the Fixed Number and Jurisdiction of the Head of Kusan-gun, the jurisdiction was divided into one Gu B, two Gu I, three Gu J, three Gu J, and K Dong. 4) On December 31, 2010, D was classified into B, E, G, N,O, and P, according to the said Ordinance.

5) On December 30, 2016, G was again subdivided into Gri, Hri, and Fri by the same Ordinance due to the increase in multi-household housing, such as Q apartment and loan in the housing site area, and the classification according to the current administrative district is as follows. RDB Ri Eri (M GriO, part of the housing site development zone, H Q apartment, part of the housing site development zone, N, and Dong in the area under the jurisdiction of Eup/Myeon name.

C. The ownership registration was completed on August 2, 2018 in the name of the Defendant on August 25, 1998, the ownership registration was completed on June 6, 2017, when the instant land was replaced by the completion of the land development project on July 2, 2008 (hereinafter referred to as “instant land”). The land category was changed and divided after the assessment was made in the name of “B/Ri” on October 30, 1914 under the Forest Investigation Ordinance. Of the divided land, the ownership registration was completed on August 25, 1998. The Defendant sold the instant land to T on June 6, 2017, and the ownership transfer registration was completed on July 4, 2017.
