1. The part against the defendant in the judgment of the court of first instance shall be revoked, and the plaintiff's claim corresponding to the revoked part shall be dismissed.

1. Facts of recognition;
가. 원고는 2014. 2. 14. 거동건설 주식회사(이하 ‘거동건설’이라 한다. 한편 거동건설의 자본금은 2,038,400,000원, 2014년도 토목건축공사업 시공능력평가액은 59,404,000,000원이다), 일성건설 주식회사(이하 ‘일성건설’이라 한다. 한편 일성건설의 자본금은 27,012,440,000원, 2014년도 토목건축공사업 시공능력평가액은 395,988,000,000원이다), 유한회사 광동(이하 ‘광동’이라 한다. 한편 광동의 자본금은 1,204,000,000원, 2014년도 토목건축공사업 시공능력평가액은 11,346,000,000원이다)과, 피고 산하 익산지방국토관리청이 발주한 고부원평천 하도정비공사(8차분) 중 2014년도분 고부천 토공사(이하 ‘이 사건 토공사’라 한다)에 관하여 공사대금 1,975,000,000원에 2014. 6. 30.까지 준공하기로 하는 내용의 하도급계약을 체결하였다.

1. Pursuant to the provisions of Article 35 (2) of the Framework Act on the Construction Industry, the ordering person shall execute the subcontract price corresponding to the portion executed by the subcontractor in the subcontract between the said contractor and the subcontractor;
