A defendant shall be punished by imprisonment for six months and by a fine of seven thousand won.

When the defendant does not pay the above fine.

Criminal facts

From August 12, 2002, the Defendant entered into a check contract in the name of the former bank branch and the Defendant, and traded household checks.

1. On July 2, 2014, the Defendant issued one copy of the foregoing bank bank check in the name of the Defendant, “E”, “5,000,000 won”, and “day of payment,” at D offices located in Seocho-gu Seoul Special Metropolitan City, Seoul Special Metropolitan City. In addition, the Defendant issued one copy of the bank bank check in the name of the Defendant on November 11, 2014.

On November 11, 2014, the Defendant presented the check to the above bank on November 11, 201, which was within the time limit for presentment for payment, but did not receive the check due to the shortage of deposit.

In addition, the Defendant issued seven copies of the household check at least seven times, such as the Nos. 2-7 and 10 in the list of crimes, and even though the check holders presented a payment proposal within the time limit for payment respectively, they failed to pay for reasons such as shortage of deposits or non-transaction.

2. On April 30, 2014, the Defendant issued one copy of the foregoing bank bank check in the name of the Defendant, “F”, “F”, “5,000,000 won”, and “date of payment,” at D offices located in Seocho-gu Seoul Special Metropolitan City, Seoul Special Metropolitan City.

On October 28, 2014, the holder of the check presented the check to the above bank on October 28, 2014, which was within the time limit for presentment for payment, but the Defendant did not pay the check in shortage.

In addition, from July 2, 2014 to July 2, 2014, the Defendant issued five copies of the household check in attached Table 2, as described in attached Table 3, 4, 5, 7, and 9, and failed to pay for each reason of shortage of deposit or non-transaction, etc., even though the Defendant presented five copies of the household check within the period of payment proposal.

3. On April 30, 2014, the Defendant issued one copy of the check number per unit of the said bank in the name of the Defendant, which is “G”, “5,00,000 won” at D offices located in Geumcheon-gu Seoul Special Metropolitan City (Seoul Special Metropolitan City) around April 30, 2014. However, on October 14, 2014, the check was presented to the said bank.
