Defendant shall be punished by a fine of KRW 500,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

The defendant is a person who drives a dump truck.

1. On December 28, 2013, the Defendant acquired money from B dump trucks by fraud to the effect that “the victim D will pay gas to his own dump trucks without fail in the following month,” at the Eump station where the victim D works in Gangseo-gu Busan Gangseo-gu, Busan, to the effect that “the victim will pay gas to his own dump trucks for the following month.”

However, in fact, the defendant was found dump truck purchaser in order to sell dump truck because he was unable to pay the installment cost of dump truck with bad credit standing at the time, and he was unable to lend the main share price of KRW 1,900,000 from F on December 1, 2013 and on December 7, 2013, and thus, he was not able to pay the share price even if he was provided with it by the victim.

As above, the Defendant, by deceiving the victim as above, was supplied through transit equivalent to KRW 621,520 on December 28, 2013 by the victim, and acquired via transit equivalent to KRW 395,140 on December 29, 2013, and acquired through fraud of KRW 1,016,660 in total.

2. On January 22, 2014, the Defendant acquired money from G dump trucks with the intent to pay gas to G dump trucks operated by F with the credit oil payment in the following month if he/she would do so, at the above Eump truck’s station around January 19:33, 2014.

However, the defendant was found out of the purchaser of dump truck in order to sell dump truck because he was unable to pay the installment cost of dump truck with bad credit standing at the time, and dump truck is not transported due to failure, and there was no intention or ability to pay the price even if the dump truck is supplied with light from the victim.

As above, the Defendant, by deceiving the victim as above, was supplied with transit equivalent to KRW 645,240 on January 22, 2014 by the victim, and was supplied with transit equivalent to KRW 431,292 on January 23, 2014, and was supplied with transit equivalent to KRW 373,560 on January 25, 2014, and was supplied with transit equivalent to KRW 1,867,80 on January 27, 2014.
