Defendant shall be punished by imprisonment without prison labor for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 25, 2014, at around 13:55 on March 25, 2014, the Defendant driving a CMF5 private taxi and proceeded with the distance front of the Twit-ro 27 (Nomno-dong) in Jeju Island from the face of the bamboo death to the face of the street.

Since there is an intersection in which a crosswalk is installed, the defendant engaged in driving of the motor vehicle has a duty of care to safely drive the motor vehicle by temporarily stopping or slowly driving the motor vehicle before entering the crosswalk, taking into account the situation of the crosswalk well, and driving the motor vehicle safely.

Suspension of execution: The grounds for sentencing under Article 62(1) of the Criminal Act (the following sentencing conditions under Article 51 of the Criminal Act as stated in the grounds for sentencing) are recommended and sentenced to the sentencing guidelines (the traffic crime group, general traffic accidents, type 1, area of mitigation of traffic accidents: Not more than 6 months: Imprisonment without prison labor: Not more than 6 months) and the following circumstances. The favorable circumstances are against the recognition of crimes: (a) the taxi is affiliated with a private taxi mutual-aid association; (b) the taxi is affiliated with a private taxi mutual-aid association and an agreement is reached with the victim; and (c) criminal punishment is imposed not more than four times by the violation of the Road Traffic Act by 204.
