A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[criminal history] On May 22, 2008, the Defendant issued a summary order of KRW 1.5 million for a crime of violating the Road Traffic Act (drinking driving) at the Daegu District Court on May 22, 2008, and a fine of KRW 1.5 million for the same crime at the same court on August 30, 2019.
[2] On September 2, 2020, the Defendant driven a coo vehicle in G with approximately KRW 500 meters alcohol concentration of approximately 0.111% from the road in Yongcheon-si B around September 2, 2020 to the front E-ray in the same city D.
Accordingly, the Defendant violated the prohibition of drinking alcohol driving regulations not less than twice.
