Defendant shall be punished by a fine of KRW 7,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. On October 13, 2012, the Defendant: (a) received the request from the victim C to borrow money from the victim C as collateral at the 107 Seo-gu, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, Y3 (D) parking lot for the 107 MM3 (D); and (b) received the said vehicle from the victim and kept the said vehicle for the victim.
Nevertheless, the Defendant received KRW 11.2 million from the representative H of G Co., Ltd. and embezzled the said vehicle by arbitrarily disposing of the said vehicle from the FF Motor Vehicle Trading Co., Ltd., at the time of the same day, the Defendant was working for the Defendant in Dong-gu
2. On January 4, 2013, the Defendant: (a) received the demand from C to return the SM3 Motor Vehicles (D) offered as security from the J golf course located in Yong-gu, Dong-gu, Yong-gu, Yong-gu, as stated in the foregoing paragraph (1); (b) proposed to C to “A person who succeeds to and purchases a right to collateral security equivalent to KRW 12 million established on the said vehicle.” (c) The FF Motor Vehicle Trading Company’s president is required to show the algoti vehicle in need of locking the algoti vehicle; and (d) proposed to C to “A algoti vehicle in need of locking the algoti vehicle to be used in the form of lease,” and kept the algoti vehicle in custody of the victim’s algoti vehicle owned by C at the market price of Korea Social Services Korea Co., Ltd., Ltd. (K) in the form of lease.
Nevertheless, on the same day, the Defendant borrowed KRW 6 million from the representative H of G Co., Ltd. at the FF Motor Vehicle Trading Co., Ltd. on the same day and embezzled the said vehicle as security.
3. On August 13, 2012, the Defendant: (a) received the said SM3 car from the victim by stating that “SM3 car (N) will be sold within one month to the victim L; and (b) received the said SM3 car from the victim; (c) received the said SM3 car from the victim and sold the said car to the OM3 car P around the end of December, 2012; and (d) received 7.5 million won from the P, and then received it from the P.
