The accused shall publicly announce the summary of the judgment of innocence.
Reasons
1. The summary of the facts charged is C, a person who establishes and operates a remote driving school under the trade name of C.
Anyone who intends to establish and operate a private teaching institute shall register his/her personal information, curriculum, name of instructors, tuition fees, facilities, etc. with the superintendent of education after entering them in an application for registration of establishment and operation of the private teaching institute.
Nevertheless, on December 21, 2011, the Defendant registered the business with the trade name called "C", and had the office in the Changwon-si, Changwon-si, Changwon-si D without being registered with the competent office of education, and operated a distance-based private teaching institute.
2. The Defendant denies the facts charged to the effect that he/she purchased lecture images from E and sold them by communication, and that he/she did not operate a distance-based driving school under the trade name C.
Article 2 subparag. 1 of the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons provides that “A private teaching institute” means a facility that provides knowledge, techniques, and arts (including consultation or other guidance necessary for entering a regular school and a distance learning using information and communication technology, etc.; hereinafter the same shall apply) to learners or many unspecified persons for at least the number prescribed by Presidential Decree, or for at least 30 days according to the teaching process for at least 30 days, or that provides them as learning places. Article 6(1) of the same Act provides that “A person who intends to establish and operate a private teaching institute shall prepare the facilities and equipment specified in Article 8 and enter the personal information of the founder, the curriculum, the name of an instructor, tuition fees, etc., facilities, equipment, etc., into an application for registration of the establishment and operation of a private teaching institute and register with the superintendent of education.
