Reasons
Punishment of the crime
[criminal power] Defendant A was sentenced to one year of imprisonment with prison labor at the Suwon District Court on November 21, 2008 and completed the sentence on August 2, 2009. Defendant B was sentenced to one year and six months of suspension of execution on June 15, 201 as a crime of violation of the Punishment of Violence, etc. Act in the Seoul Western District Court on June 15, 201, and was sentenced to three years of suspension of execution on June 23, 201 and is currently under the grace period.

1. The Defendant: (a) asked women using high-priced smartphones while getting on and going with the Defendant to borrow a smartphone by asking them to lend the cell phone; (b) received smartphones from them; and (c) made them with a view to theft by getting on and departing from the Otoba.
At around 22:40 on February 19, 2012, the Defendant discovered the Victim F containing smartphone in front of the 10-galthoon village 10 complex in Gyeyang-gu, Seoyang-gu, Young-gu, Gyeonggi-gu, the Defendant stolen a smartphone, the market price of which is equivalent to 890,000 won in the victim’s possession, by demanding that the female borrow a mobile phone, and making a phone for the galth of the smartphone.
From that time to April 13:00 on April 2, 2012, the Defendant stolen smartphones worth KRW 91,602,000 in total from the victims in the same manner as the list of crimes in the attached Table 111 times.
Accordingly, the defendant habitually stolen another's property.
2. On February 2, 2012, Defendant B distributed the leaflets stating “G mobile communications, the highest price for Handphones, and H” to taxi drivers, with the mind of having customers purchase and sell mobile phones stored in the taxi on the roads near the Eunpyeong-gu Seoul Metropolitan Government (Seoul).
The Defendant, from the beginning of February 2012 to March 23, 2012, made it impossible to contact with the Defendant to sell smartphones lost to the above mobile phone on the roads near the said railroad station.
