Reasons
Punishment of the crime
On November 30, 1993, the Defendant was sentenced to the suspension of the execution of larceny for 6 months at the Seoul Central District Court, 8 months at the Seoul Central District Court on October 20, 1994, 2 years of the suspension of the execution of larceny for 10 months at the Seoul Northern District Court on August 14, 2003, 2 years of the suspension of the execution of larceny for 1 year at the Seoul Central District Court on June 30, 2004, 1 year and 6 months of imprisonment for 1 year and 6 months of the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul Central District Court on August 30, 2007, and 1 year and 6 months of imprisonment for 1 year and 6 months at the Seoul Western District Court on September 4, 2009, respectively.
The defendant steals a cell phone from the drunk passengers in the subway train, and disposes of it and raises a living allowance, etc.;
1. On March 27, 2015, around 22:45, the 22:45 subway line 2: (a) finds out that a drunk victim C (mainam, 45 years old) was locked by 9:70,000 won of the market value of its possession, “Aphone 5” and then steals a mobile phone using a crepan in which the victim does not see any other part of the mobile phone; and (b) steals it with the mobile phone, which is equivalent to the 9.70,000 won of the market value;
2. At around 23:35 on the same day, the victim D(Nam, 19 years old) under the influence of alcohol is found to have set aside a cellular phone in the range of 90,000 won, which is its own market value, by breaking it under the bottom of the gallon S4’s cellular phone, and by using the cres in which the victim is no longer deemed to have different; and
3. On the same day 23:37, within the power-driven vehicle moving from the new subway 2 lines to the alternate station, the victim E under the influence of alcohol ( South and in the age of 20) finds out the cell phone of the 900,000 won of the market value of his possession at the point of a galgal block S5 cellular phone located in the main machine, and by using the difference in which the victim does not see any one.
