A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

1. From August 2013, the Defendant was employed as an employee in charge of accounting of the Foundation D (hereinafter “this Foundation”) located in Daejeon Sung-gu Daejeon (hereinafter “the Foundation”) from around August 2013, and was in charge of the revenue and expenditure of the funds owned by the Foundation.

On September 30, 2013, at the office of the Foundation, the Defendant prepared an expenditure resolution for the execution of funds related to the business of the Foundation, and obtained approval from E, etc., an appointing administrative officer of the Foundation, and created the password by obtaining the OTP device connected to the deposit account in the name of the Foundation, in which E, would make a transfer to E, using Internet banking, and by obtaining the landmark device connected to the deposit account in the name of the Foundation.

The Defendant entered the above passwords into the computer installed in the Foundation Office, completed the transfer of Internet banking devices according to the disbursement resolution, and subsequently proposed that the new passwords to be used for the Internet banking device was additionally generated from the OTP device before returning the above OTP device to E.

The Defendant immediately entered the secret identification number on the same computer and remitted 5,580,581 won to the Agricultural Cooperative Deposit Account (Account Number F and Account Holder G) that the Defendant used in the name of the Foundation in the name of the same computer, and transferred the total amount of KRW 320,580,581 in the same way until June 10, 2014, as indicated in the attached crime list, and then withdrawn it in cash and used it for personal use, such as gambling funds.

As a result, the defendant obtained 320,580,581 won property benefits by inputting information without authority into the data processor, such as computer, and suffered property damage equivalent to the same amount.

2. On September 9, 2013, the Defendant forged private documents: “H” and “1,798,920 won in the claim amount column in the account number column of the request for deposit of a new bank at the office of the Foundation.”
