Reasons
Punishment of the crime
The Defendant, a e-commerce company, worked from August 2016 to April 2020 at the victim B corporation (hereinafter “victim company”), a e-commerce company, (hereinafter “victim company”), and the victim company, regardless of whether or not the returned goods have arrived at the consumer’s request for refund or whether or not the goods have been actually lost, performed the “pre-paid refund system” that would first refund the purchase price in the victim company to the seller, but did not check whether or not the goods have been returned to the seller or have been actually lost, and argued that the purchased goods have not been delivered in the course of the delivery, or argued that the goods have not been returned to the seller, or that the goods have not been delivered in the course of the theft and delivery, and attempted to commit the crime by acquiring economic benefits equivalent to the same amount, or by taking over the goods by delivery.
On or around December 28, 2019, the Defendant: (a) informed the Defendant: (b) informed the Defendant’s residence in Songpa-gu Seoul Metropolitan Government Office Officetel D; (c) despite having been delivered the Defendant’s “Nururler Ctel Ctel sets” equivalent to KRW 2,218,080 at the market price from the Victim Company, the Defendant deceiving the Victim Company by filing an application for refund as if he lost the pertinent goods; and (d) informed the Victim Company of the loss of the said goods; and (c) had been refunded by cancellation of the credit card settlement approval for KRW 2,218,080 at the Victim Company around January 4, 2020; and (d) from around December 26, 2019 to February 20, 202, the Defendant attempted to acquire KRW 10,263,760 in total over eight times, including [Attachment Table 1 through 8], and attempted to obtain the Defendant’s total amount of KRW 10,390,19,390.
