피고인은 2018. 8. 12. 02:15경 안동시 B 소재 C식당 앞길에서, ‘C식당 바로 옆집 싸움’이라는 112신고를 받고 출동한 안동경찰서 D지구대 소속 경사 E 등 경찰관 4명이 사건 경위를 파악하려 하자 위 경찰관들에게 ‘누가 신고했느냐, 짭새들아.’라고 욕설을 하였고, 이에 경사 E, 경위 F이 피고인에게 귀가하라고 말한 후 G 순1호 순찰차량에 탑승하여 시동을 걸고 지구대로 귀소하려 하자 위 순찰차량 앞에서 양팔을 벌려 순찰차의 진로를 가로막고, 순찰차 운전석 옆문을 손으로 수회 내리쳐 경찰공무원의 112신고 처리 업무 및 순찰 업무에 관한 정당한 직무집행을 방해하였다.
