A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On May 7, 2009, the Defendant was sentenced to one year of imprisonment with prison labor for night building intrusion, larceny, etc. at the Seoul Eastern District Court on July 22, 201, and sentenced one year of imprisonment with prison labor for night building intrusion, attempted larceny, etc. at the Jung-gu District Court on July 22, 201, and sentenced one year and six months of imprisonment with prison labor for violating the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Jung-gu District Court on July 26, 2012, and completed the execution of the sentence on December 19, 2013.

1. On May 16, 2014, at around 20:50, the Defendant: (a) opened a back door shocker with the victim D’s “E” restaurant operated by the Government of the Gyeonggi-do, and intruded into the said restaurant and stolen cash owned by the victim, who was suffering from the wall to the said restaurant; (b) one head of one bank, one resident registration certificate, one resident registration certificate, and one driver’s license, with one wheelchairs of the market value equivalent to KRW 30,000,000 in the market value.

2. On May 31, 2014, at around 21:00, the Defendant invadedd the victim G’s house located in the Government City of Gyeonggi-do, to the second floor through open gates, and colors stolen objects, but the inside was not found to have stolen objects, and again, the Defendant did not commit an attempted crime because it was discovered to H residing in the first floor of the said house and arrested the stolen objects, while saving them into the first floor through stairs.

As a result, the Defendant was sentenced to imprisonment not less than three times with prison labor due to the following crimes: night building intrusion and larceny, night building theft, attempted larceny, and violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; and the Defendant again committed at night, robbery, or attempted larceny at night, within three years after the execution of the sentence is completed.
