A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 23:00 on May 25, 2013, the Defendant driven BM5 car under the influence of alcohol leveling 0.105% from the 3km section of Gwangju Seo-gu to the front road of the “Sari-dong 1237-9, Seo-gu, Seo-gu 1237-9” (hereinafter “Sari-dong 948-1”).
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicles) and the Road Traffic Act (Non-accidenting Measures) are those engaged in driving of BM5 vehicles;
On May 25, 2013, the Defendant driven the said car while under the influence of alcohol on May 23:10, 2013, while driving the said car at a low speed, driving the runway in front of the said “pre-use pharmacy” at a low speed from the jurisdiction of the Seogju Island to a re-defluence, and entered the runway and the three-lane road. Ultimately, the Defendant, by occupational negligence, sustained bodily injury, such as “finites and tensions,” which requires approximately two weeks’ medical treatment, and injury to the victim E (the victim 26 years old), who is the passenger of the victimized vehicle, such as “finites and tensions,” which requires approximately two weeks’ medical treatment, and at the same time, damaged the damaged vehicle so that the sum of repairing costs would be equal to KRW 8,080,367, and the damaged vehicle would be damaged to the roadside due to the shock of the accident.
