가. 업무방해 피고인은 2014. 3. 1. 02:00경부터 같은 날 03:00경까지 사이에 안동시 E에 있는 피해자 F이 운영하는 ‘G’ 식당에서 손님이 가득 차 식당 내에 앉지 못하고 식당 밖 탁자에 앉게 된 것 때문에 불만을 품고는 피해자에게 욕설을 하며 험악한 분위기를 조성하다가 피해자가 불친절하고 자신의 몸에 손을 댔다는 이유로 “씹팔년, 개 같은 년아, 장사를 이따구로 하냐, 미성년자한테 술 팔아 먹지마라”라고 소리치고, 자리를 이동하였다가 다시 찾아와 피해자를 때릴 것처럼 위협을 하면서 식당 뒤쪽으로 데리고 나가 “이 씹팔 죽여분다”라고 말하면서 피해자의 얼굴을 때릴 듯이 오른손을 치켜들고, 의자로 수족관을 파손하려고 하는 등 소란을 피워 위력으로 피해자의 식당영업 업무를 방해하였다.
