A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant of a private document forgery is a person operating “C” for the purpose of electrical construction business, etc., and D purchases from Gyeong-gun F, Seongbuk-gun F, and ordered a water source facility 300kmW construction (hereinafter “the instant electrical construction”). G is a person entrusted with the sale and purchase of real estate between D and E and D, and is a person entrusted with the sale and purchase of real estate between D and E and E.

From the time of June, 16, the Defendant conducted consultation on the instant electrical construction by presenting a written estimate for construction to the said G, and concluded the instant electrical construction contract with G. At that time, the Defendant prepared and printed the electrical construction contract stating “D” in the name column of construction using a computer network program at his own office located in Gyeongnam H to maintain the same as “a direct contract with the ordering person D,” and had the Defendant prepared and printed it in the name column of construction using the computer network program in the name column of construction.

On August 18, 2011, in order to prepare an application for electrical use under the name of the owner (D) who is a document necessary for electrical construction, the Defendant obtained D’s seal impression from K, an agent of the victim, at the above F F F Construction site, and without authority, affixed D’s seal impression on the name side of D’s name under the above electrical construction contract for the purpose of exercising it as an opportunity.

Accordingly, for the purpose of exercising authority, the Defendant forged a copy of the electrical construction contract in the name of D, a private document on rights and obligations.

After concluding the instant investigation document and the instant electrical construction contract with G as stated in the foregoing paragraph 1, the Defendant concluded the instant electrical construction contract, and completed the said construction from August 19, 201 to October 25, 201, and the instant electrical construction proceeds are half of the victims who purchased the said F and E, a seller.
