A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On August 4, 2013, the Defendant of the obstruction of performance of official duties: (a) at around 00:30 on August 4, 2013, the Defendant, upon receiving a report from the front corridor of the entrance No. 31201 Dong 409, the Defendant: (b) was urged to return home from the D Zone D Zone Hac Police Station Hack E, dispatched to the said site, and without any justifiable reason, she saw the Defendant to go home from the Defendant; and (c) the Defendant, upon receiving a report from the Defendant: (a) was spiting the Defendant’s sexual flag in front of the entrance No. 31201, Dong 409, Seoul Central-gu, Seoul, the Defendant: (b) was frighted; and (d) the Defendant interfered with the legitimate execution of public duties by a police officer who voluntarily withdrawn protective measures, etc. for the sake of public peace and maintenance of order by breaking the face of the E’s police uniform.

2. Definating;

가. 피고인은 2013. 8. 4. 00:20경 제1항 기재 장소에서 성기를 내놓은 채 알몸 상태로 누워있던 중, “모르는 사람이 옷을 홀딱 벗고 집 앞에 누워 있어 무서우니 도와 달라”는 409호 거주자의 전화연락을 받고 온 피해자 F로부터 “여기 친구 집 앞이니까 어서 옷 입고 가 주세요”라는 말을 듣자 409호 거주자 G의 부모님, 현장 출동 경찰관 3명, 아파트 주민 3명이 지켜보는 가운데 피해자에게 “야! 씹할 놈아! 너 몇살이야 개새끼야! 너 일루 와봐 죽여 버릴라!”, “너 뭐야! 너 똘아이 아니야! 너 미쳤어! 너 죽는다” 등의 욕설을 하여 공연히 피해자를 모욕하였다.

B. While the Defendant received a report at the time and place indicated in paragraph (1) and solicited the victim H, who is a police officer belonging to the Seoul Southern Police Station D Zone D District, to return home at the said site, the Defendant publicly insultingd the victim by referring to the reporter, the reporter’s relative two persons, and three apartment residents, who are in compliance with the victim’s order.
