The judgment below

Examining the evidence duly adopted by the court of first instance, the court below’s determination that the Defendants guilty of occupational breach of trust among the facts charged in this case on the grounds stated in its reasoning is justifiable. Contrary to what is alleged in the grounds of appeal, the court below did not err by exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by misapprehending the legal principles as to major assets

Supreme Court Decision 2006Do8278 Decided July 10, 2008 cited in the ground of appeal is different from the case of this case, and thus, it cannot be invoked in this case.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
