1. The Defendants jointly do so to the Plaintiff:

(a) the first floor of the real estate listed in the Schedule 1, 1, 2, 2.

Reasons

1. Determination as to the cause of claim

가. 인정사실 ⑴ 원고는 2011. 11.경 피고들과 사이에 원고 소유의 별지 목록 기재 부동산의 1층 중 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㄱ의 각 점을 차례로 연결한 선내 ‘㈃’ 부분 66.43㎡(이하 ‘이 사건 건물’이라 한다)에 관하여 임대차보증금 500만 원, 임대차기간 2011. 11.부터 2013. 11.까지, 차임 매월 20만 원(매월 말에 지급)으로 정하여 임대하기로 하는 내용의 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였다.

B. The Defendants do not pay rent from July 2014 when the instant lease agreement was explicitly renewed and maintained, and the Defendants possessed the instant building.

Accordingly, the Plaintiff declared to the Defendants that the instant lease agreement will be terminated on the grounds of the delinquency in rent, and the duplicate of the instant complaint stating the said declaration of intent was served on Defendant B on July 8, 2015, and on August 4, 2015, Defendant DaelB Co., Ltd., Ltd., respectively.

B. The instant lease agreement was terminated by the Plaintiff’s declaration of intention to terminate the contract for reasons of delinquency in the rent of the Defendants. As such, the Defendants, as joint lessees, are jointly obligated to deliver the instant building to the Plaintiff, and to pay the Plaintiff the rent or unjust enrichment equivalent to the rent, calculated by the ratio of KRW 200,000 per month from July 1, 2014 to the completion date of delivery of the instant building.

2. In conclusion, the plaintiff's claim against the defendants is with merit, and it is so decided as per Disposition.
