A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 21, 2017, the Defendant proposed “F” main points of “F” operated by the Defendant located in Mapo-gu Seoul Mapo-gu, Seoul, as “F,” the victim G (WW 23 years old, so far as you have come to know of face,” and tried to commit indecent acts or rape after having the victim left with the Defendant.

1. 2. 준 유사 강간 피고인은 제 1 항의 일 시경 같은 장소에서 피해자가 술에 취하여 의식을 잃고 쓰러지자 피해자의 오른쪽 가슴을 손으로 만지고 혀로 핥고, 피해자를 그곳 주방 입구로 끌고 가 바닥에 앉힌 후 자신의 바지를 벗고 성기를 꺼 내 피해자의 입 안에 넣으려 하고, 이에 잠시 깨어난 피해 자가 피고인에게 “ 자주 오는 여자 분이 여자친구 잖 아요, 이렇게 하시면 안 되는 거 아닌가요.

"A person who has lost his mind" means "the face of the victim has been put in the drafting of a return by hand."

Accordingly, the Defendant, under the influence of alcohol, committed similar rape by using the victim’s physical and mental loss or the state of arbitrariability.
