피고인은 2019. 7. 13. 03:00경 고양시 덕양구 B에 있는 피해자 C(가명, 여, 42세)의 주거지에서, 피해자와 저녁식사를 하고 피해자의 집에 데려다주겠다며 함께 엘리베이터를 타고 피해자의 주거지로 올라간 후 피해자가 그만 돌아가라고 하였음에도 현관문을 열고 들어가는 피해자를 따라 위 주거지 거실 안까지 들어가, 손으로 피해자를 소파에 밀어 눕히고 몸으로 피해자를 눌러 반항을 억압한 다음, 피해자에게 입맞춤을 하려하고 피해자가 고개를 옆으로 돌리며 거부하자, 손으로 피해자의 턱 부위를 잡고 계속 입맞춤을 하려하고, 피해자의 상의를 올려 손으로 피해자의 가슴 부위를 만지고, 혀로 피해자의 가슴 부위를 핥고, 피해자의 바지와 팬티를 함께 내려 손가락을 피해자의 음부 부위에 수회 집어넣었다.
