1. Defendant A
A. One violation of the Financial Investment Services and Capital Markets Act (hereinafter “Financial Investment Services and Capital Markets Act”), F, and G set up and operate a private futures trading site of the mutual name “H” in order to conduct domestic and foreign futures trading, with a view to: (a) the high amount of deposit is necessarily required; (b) if the deposit is not paid, it is impossible to conduct futures trading; (c) the non-member is recruited; (d) the members are distributed; (e) the members choose the gift items, quantity, and the type of items selected; and (e) the members made an order for purchase; and (e) the members made an order for purchase; and (e) the members made an order for the purchase; and (e) the Defendant made the use of the foreign futures trading site of BJ (personal broadcaster, Brody's disadvantaged party) of the website of the Financial Investment Services and Capital Markets Act (including personal broadcast service providers; and (e) the members of K, 'K', 'L', and 'L' to take charge of public relations at the Internet site’ in order.
According to the above public offering, the Defendant: (a) through the real-time brokerage of price index, such as domestic gifts, domestic options, international gold, international gold, international markets, oil paintings, and Japan, from October 2016 to June 15, 2017; (b) led the employees of the customer center to transmit HTS to regular members by e-mail; and (c) led the employees of the customer center to establish the HTS by transmitting the HTS to regular members; and (d) deposited KRW 3,286,22,724 in the name of the HTS account; and (e) received KRW 3,286,222,72,724 in total with the HTS account; and (e) deposited domestic gifts, domestic markets, domestic markets, international markets, international markets, U.S., and the Korea Agricultural Cooperative account (T) to conduct futures trading by predicting the change; and (e) opened and operated a market for financial investment instruments without obtaining permission for the Exchange.
