『2019고단1111』 [공모관계] 피고인은 2019. 9.경 R와 함께 S 어플리케이션이나 인터넷 T U 카페에 에어팟2, 갤럭시 버즈를 판매한다는 글을 게시하고, 물건대금을 지급받은 후 약속한 물건을 보내주지 않는 방법으로 피해자들을 기망한 후, 피해자들로부터 받은 돈을 절반씩 나누어 가지기로 공모하였다.

피고인은 2019. 9. 23.경 위와 같은 공모에 따라 R와 함께 안산시 V 모텔에서 S 어플리케이션에 에어팟2를 판매한다는 내용의 글을 게시하고, 이를 보고 연락한 피해자 W에게 “14만 원을 보내주면 에어팟2를 보내주겠다”고 거짓말하였다.
