A defendant shall be punished by imprisonment for four months.

Criminal facts

1. On June 2012, the Defendant: (a) forged private documents; (b) borrowed money from D with firs C; and (c) concluded a lease agreement with E with a lessor of a newly built house to be employed as a patrol officer at KRW 10 million; (c) forged a lease agreement as if it had caused KRW 20 million; and (d) used money from D to borrow KRW 20 million.

Around June 30, 2012, at the G Licensed Real Estate Office of Dobong-gu Seoul Metropolitan Government, where the Franchisor was located in the first floor, the Defendant, in collusion with C, requested the broker H to enter the said B’s monthly housing rent contract, Dobong-gu Seoul Metropolitan Government I, the seat of the deposit, the deposit, the down payment, the remainder million, the monthly payment, the lease, the E, and the lessee D by means of the computer. On the same day, the Defendant had the seal of the above E, which was voluntarily made, stamped to the said H, affixed to the E’s name, and then, delivered the forged monthly housing rent contract to D as if the document was duly formed, thereby forging the rights and duties.

2. On June 2012, the defrauded concluded a lease agreement with the lessor of the newly built house and the lessor of the newly built house to pay KRW 10 million, in spite of the fact that the Defendant did not have any fixed income and there was no other property, at the time of the victim D’s house located in J Apartment 102 Dong 1001, Seoul Special Metropolitan City, Nowon-gu, the Defendant: (a) concluded a lease agreement with the lessor of the newly built house to pay KRW 10 million; (b) on the part of the victim, the Defendant would make a lease agreement with the lessee under the name of the victim if the Defendant borrowed KRW 20,000,000 to be used as the lease deposit of the newly built house; and (c) completed a lease agreement with the lessee by October 26, 2012, the Defendant would pay KRW 5 million in cash on the part of the victim, i.e.,, the Nonparty received KRW 3,000, Jun. 30, 2012.
