1. The Defendant in breach of trust is an owner of a 21 foot number system (hereinafter “D”) organized by around November 8, 2016.

On June 11, 2018, the Defendant received KRW 23.8 million ( KRW 20 million and interest KRW 3.8 million) from the members of the fraternity of the said fraternity at a non-permanent place in Hongsung-gun Hong-gun, Hongsung-gun, Hongsung (hereinafter referred to as "Songsung-gun, Hongsung-gun") from the members of the fraternity, and therefore, the Defendant had the duty to pay KRW 23.8 million to the victims E of the fraternity designated as the members of the fraternity on the same day.

Nevertheless, the defendant did not pay the money to the victim and consumed it according to the mind, such as paying the money to the members of other two numbers of the defendant organized by the defendant, or repaying personal debts.

Accordingly, the defendant acquired property benefits equivalent to 23.8 million won, and suffered damages equivalent to the same amount as the victim.

2. On January 17, 2018, the fraud Defendant made a false statement to the victim H that “I would lend money due to a shortage of operating capital to the Defendant’s management,” from the Galle of the Defendant’s operation in the Hongsung-gun F.
