Summary of Grounds for Appeal

The punishment (two million won of a fine) imposed on the defendant by the court below is too unhued and unfair.

Judgment

In light of the fact that the amount obtained by the Defendant from the victim D exceeds KRW 100 million, it is necessary to punish the Defendant strictly. However, considering all of the circumstances of the instant crime including the fact that the Defendant agreed smoothly with the victim D when the Defendant was in the trial, and that there was no history of the same criminal act, the Defendant did not have any history of the same kind of crime and all the sentencing conditions specified in the records and arguments, such as the circumstances of each of the instant crimes, means, and the circumstances after the crime, it is deemed that the Defendant’s punishment against the Defendant is too unreasonable, and thus, the Prosecutor’s assertion

In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
