A defendant shall be punished by imprisonment for a maximum term of four years and a short term of three years.

The defendant is about 120 hours of sexual assault treatment program.

Punishment of the crime

1. 피해자 D에 대한 강간미수 피고인은 2013. 3. 31. 16:00경 서울 은평구 E 부근 친구 F의 집에서 같은 반 친구인 피해자 D(여, 15세) 및 다른 친구들과 놀던 중, 위 피해자만 남고 다른 친구들이 귀가를 하자 위 피해자에게 입맞춤을 하고, 이에 위 피해자가 "하지 말라"고 거부하자, 두 손으로 위 피해자를 침대에 눕힌 후 그 위에 올라타 입을 맞추고 가슴을 만지고 속바지 위로 음부를 만지고, 위 피해자의 치마를 걷어 올려 팬티를 벗기려고 하여 위 피해자가 피고인을 밀쳤고, 그 후 위 피해자의 상의 옷 속으로 얼굴을 넣어 가슴을 빨고, 속바지를 입은 위 피해자의 음부 부분을 바지를 입은 상태로 피고인의 성기 부분으로 문지르고 손으로 만지고 혀로 핥는 등 강간하려고 하였으나, 위 피해자가 완강히 반항하고 때마침 피고인의 어머니로부터 전화가 걸려와 미수에 그쳤다.

2. On April 9, 2013, the Defendant committed indecent act by compulsion against the victim I at the Defendant’s house located in Mapo-gu Seoul Mapo-gu J 1, 2013, where the victim I (the female, 15 years of age) was “influoring the inside to nurse,” and the victim I (the 15 years of age) was “influoring the inside to nurse,” and the above victim was as soon as possible, she was fluored by hand, she was fluor, she was fluor, she was fluord by drinking, and she was fluored by indecent act.
