Reasons
1. The reasoning for the court's explanation on this case is that the plaintiff was not subject to disciplinary action prior to the disposition of this case and received official commendation from the superintendent of education twice, the plaintiff can reduce disciplinary action pursuant to Article 4 (1) 2 of the former Rules of Public Educational Officials." (5) The plaintiff did not have been subject to disciplinary action prior to the disposition of this case and received multiple official commendation including official commendation from the superintendent of education twice. Since the plaintiff's class is a school principal, it is subject to mitigation pursuant to Article 4 (1) 2 of the former Rules of Public Educational Officials who can reduce disciplinary action, but Article 15 of the Decree on Disciplinary Action of Public Educational Officials provides that "in deciding a disciplinary case, a majority of official commendation of the plaintiff should be taken into account as to the plaintiff", and Article 4 (1) 2 of the former Rules of Public Educational Officials, Article 16 (1) 2 of the Public Educational Officials Act and Article 8 (1) 2 of the former Rules of Public Educational Officials and Article 8 (2) of the Civil Procedure Act shall be deleted."
(2) If the plaintiff's claim in this case is reasonable, the plaintiff's claim in this case is justified, and the judgment of the court of first instance which accepted the plaintiff's claim in this case is just, and the defendant's appeal is just in this conclusion. Thus, the defendant's appeal is dismissed as it is without merit. It is so decided as per Disposition by the assent of all participating Justices on the bench.
