피고인들은 2018. 12. 13.경부터 2019. 7. 18.경까지 위 게임장에서, 바다9000 10대, 미스터손 20대 등 게임기 60대를 설치하여 게임장을 방문한 불특정 다수의 손님들로 하여금 위 게임물에 현금을 투입하고 1원당 1점을 부여하여 1회당 100원이 차감되는 방식으로 게임자동진행장치(속칭 ‘똑딱이’)를 이용하여 게임을 하도록 하고, 손님들로부터 환전을 요구받으면 손님들이 게임을 통해 획득한 점수에서 수수료 10%를 공제하고 환전을 해주었다.
