Reasons
Punishment of the crime
【Defendant B, on January 11, 2015, was sentenced to two years of suspended execution for a violation of the Military Service Act at the Incheon District Court on April 19, 2015, and the judgment became final and conclusive on the 19th day of the same month.
1. Joint crimes committed by Defendant B and G;
A. Fraud 1) The Defendant and G, along with H, opened a cell phone in the name of a juristic person through the establishment of a floating juristic person, and did not pay the mobile phone price, etc., and sold the cell phone, etc., and Defendant B took charge of the above series of crimes. H received 600,000 won per juristic person for the establishment of a juristic person in its own name, instead of establishing a juristic person in its own name, and G intended to open a cell phone, radio Internet, etc. in the name of the floating juristic person established by H as above.
On February 21, 2013, the Defendant and H established the KJ in the same manner as the in-house director of H via the Internet, and around July 5, 2013.
On February 26, 2013, the Defendant and G continuously presented the victim KT L L L located in Seocheon-gu, Nowon-gu, Seoul Special Metropolitan City on February 26, 2013, and made a false statement as if the Defendant would normally pay the user fee on the opening of the Internet line under the name of the Defendant Company I.
However, the defendant and G only attempted to sell the horse after opening the Internet line, and there was no intention or ability to pay the radio Internet fee normally.
Nevertheless, the Defendant and G, as above, deceiving the victim and let the victim open the 20-time radio-Internet on the same day, did not pay 2,209,280 won for the fee, thereby acquiring property benefits equivalent to the same amount. Furthermore, from the above day to August 9, 2013, the Defendant and G opened the 261-time radio-Internet via the 261-time line from the above day to August 15, 2013, and paid a total of 21,401,024 won for the fee.
