Defendant
A shall be punished by imprisonment with prison labor for one year and two months, and by imprisonment with prison labor for ten months.
However, as to Defendant B, the same shall apply.
Reasons
Punishment of the crime
Any person who intends to import, export or return goods shall file a report thereon with the head of a customs office on the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree.
1. Defendant A
A. A. The Defendant agreed to receive a proposal from a person under whose name the Defendant resided in China (hereinafter “E”) that he would receive a gold in China to pay money for the Myeon transportation expenses by bringing in the Republic of Korea from the person under whose name the Defendant was living in China. From January 26, 2015 to September 24, 2015, the Defendant imported five gold bars (200 g, a total of 1 g, a total of 32,620,50 won, and a total of 10 g, a total of 10 g, and the cost of goods 32,620,500 won, and imported five gold bars by bringing them into Korea without filing a report with the head of the customs office, and by bringing them into Korea in the way of carrying them into Korea, from around that time, to September 24, 2016, the Defendant imported goods from 101 to 30 g,40 g,40 g,75 g, and 101.
B. The Defendant agreed to receive a proposal from a person who resides in China (hereinafter “E”) to again remove gold bars brought in from China to Japan, and to pay money as face-to-face transportation expenses. On February 24, 2016, the Defendant: (a) on board the Incheon International Open Port to Japan and then left Korea; and (b) on February 24, 2016, on five gold bars (200 g per page, total of 1 kg, total of 48,140,000 per page, total of 48,140,000 per page) delivered by the above person in the name of the deceased; and (c) on the basis of concealing five gold bars, five gold bars were sealed to the head of the customs office without filing a report; and (d) around that time, from May 8, 2016 to May 12, 200, Japan’s price of goods with the same amount of 12 k 200 g,50 g.
2. Defendant B
A. The Defendant is a deceased person (E) who resides in China.
