A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2015 Highest 409] From 2006 to 2006, the Defendant purchased land and sold land and buildings or possessed land on the land after purchasing D’s land, and the market price of the land has increased. E is the Fron General from December 16, 2005 to December 1, 2007, and thereafter, while working as a staff member of the G Operation Support Team, the review of the operational nature of the land within the military facility protection area was opened and presented as a public official, and the Defendant and E were close to only the introduction of H Grand Order around 2006, which was the president of G Ha, and the Defendant was the owner of the land in the region of the Republic of Korea on April 4, 2008.
From November 29, 2005 to April 10, 2008, the Defendant applied for a construction permit on the land of the NA on five occasions, including the above J, the owner of the building on five occasions. However, as the Defendant was unable to obtain a construction permit with G’s side consent, he was able to obtain consent through E, three copies of the KRW 1 million check at the G Center in April 2008, three copies of the Defendant’s account in the name of the Defendant’s wife on May 16, 2008, with KRW 10 million with the agricultural bank account in the name of E (Account Number L) via the Defendant’s account in the name of the Defendant’s wife on May 21, 2008, KRW 2 million with the NAC’s account on May 21, 2008, KRW 300 million with the total deposit account of KRW 508,500,000,000 by means of the NAC, around May 222, 20008.
Accordingly, the defendant provided a bribe to E who is a public official in consideration of convenience in the consultation on the operational review of land in the military facility protection area.
