Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The defendant tried to acquire dump trucks from the victims who come to know at the sump truck p trucks at the low price, due to the lack of living expenses, against the victims who come to know at the sump truck in the Asan city in an economically difficult situation.

1. On July 3, 2017, the Defendant made a phone call to the victim B at the observer’s office located in Ansan-si, Asan-si, and made a false statement stating, “If the Defendant wishes to commit an accident, he/she will transfer money to the victim B, the Defendant sold to the victim at KRW 480,000 per unit of 15,00 won in 385,000,000,000,000,000,000 won per unit of 12R (the back).”

However, in fact, the defendant thought that he will use the money received from the damaged person for the cost of living, and did not have the intention or ability to purchase the money in a low manner even if he received the money from the damaged person.

On July 3, 2017, the Defendant, by deceiving the victim, received 1.5 million won from the Saemaul Treasury account in the name of the Defendant to the Saemaul Treasury account in the name of the Defendant on July 7, 2017, and acquired 1.3 million won from the Defendant to the Saemaul Treasury account in the name of the Defendant on July 7, 2017.

2. On August 8, 2017, the Defendant called the victim E by phone at the same place and made a false statement to the victim E, “If there is any think that the Defendant would purchase any other amount of KRW 480,00,00 per unit because he/she sold any other amount of 385,000,000,000 won.”

However, even if the defendant received money from the injured party, he did not have the intention or ability to purchase the money in a low manner.

On August 9, 2017, the defendant received 1920,000 won from the victims to the Saemaul Treasury account under the name of the defendant on the pretext of four payments from the victims.
